Dabei geraten zunehmend einzelne Stoffgruppen in den Fokus spezifischer Regulierungen, z. B.: - Stoffe, deren karzinogene, keimzellmutagene oder reproduktionstoxische Wirkung in unterschiedlichem Maße nachgewiesen ist (CMR-Stoffe), - Stoffe, die im Verdacht stehen, allergische Reaktionen auslösen zu können (Allergene), - Stoffe, die als ,,endokrin wirksam" bezeichnet werden, sowie - ,,Nanomaterialien". Jenseits dieser speziellen Stoffgruppen ist die Kosmetikbranche seit geraumer Zeit von einer Diskussion um die sog. Naturstoffe erfasst, wobei hinsichtlich der Bedeutung dieses Begriffs noch viele Fragen ungeklärt sind. Schon die Erkennung der Zugehörigkeit einer Substanz zu einer dieser Gruppen erfordert die Berücksichtigung der entsprechenden Vorgaben des allgemeinen Chemikalienrechts. Darüber hinaus entfaltet dieses seinerseits bestimmte Wirkungen auf die kosmetischen Mittel. Damit ergeben sich Überschneidungen zwischen dem allgemeinen Chemikalienrecht und dem Kosmetikrecht. Erschwerend kommt hinzu, dass die Regeln des allgemeinen Chemikalienrechts, soweit sie die Einstufung von Stoffen zum Gegenstand haben (d. h. die systematische Vorgehensweise zur Erkennung der von ihnen ausgehenden Gefahren), zur Zeit im Umbruch sind: Das bisherige System, bestehend aus der Richtlinie 67/548/EWG (für Stoffe) und der Richtlinie 1999/45/EG (für Gemische bzw. früher Zubereitungen) wird schrittweise durch das auf dem Globally Harmonized System (GHS) basierenden, neuen System der CLP-Verordnung ersetzt (VO 1272/2008). Diese schrittweise Ersetzung bedingt ein Nebeneinander der beiden Systeme, welches noch bis zum 01. Juni 2015 anhalten wird. Dies beeinflusst auch die stoffbezogenen Regulierungen des Kosmetikrechts. Gleichzeitig vollzieht sich seit dem Inkrafttreten der neuen Kosmetikverordnung (EG) Nr. 1223/2009 am 11. Januar 2010 die schrittweise Ablösung der Kosmetikrichtlinie 76/768/EWG. Dieser Prozess wird zum 11. Juli 2013 enden. Ab diesem Zeitpunkt erlangt die neue Verordnung ihre umfassende Geltung.
